This Terms of Service agreement ("Agreement") is a legally binding contract between you ("User") and Brighter Days Advisory LLC, a Texas limited liability company doing business as Post Assembly ("Company," "Post Assembly," "we," "us," or "our").
BY CREATING AN ACCOUNT, LOGGING IN VIA LINKEDIN OR GOOGLE, OR USING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THIS AGREEMENT.
1. Eligibility
You represent and warrant that you are at least eighteen (18) years of age.
2. User Content (Input)
You retain all ownership rights to the text, audio, and video content you upload. You grant Company a limited license to process this content solely to provide the Service.
3. Intellectual Property Warranty
You represent and warrant that you own or have the legal right to use any content you upload. You agree that your content will not infringe upon the intellectual property rights of any third party. You may not upload content that infringes copyrights, trademarks, or other proprietary rights.
4. Output Ownership
Subject to payment of fees and compliance with third-party AI provider terms, Company assigns to you all rights to the content generated by the Service based on your Input.
5. No Refunds
ALL SALES ARE FINAL. Company offers no refunds or credits for any reason, including early cancellation.
6. Indemnification
You agree to defend and indemnify Company from any claims, damages, or legal fees arising from your User Content or your violation of third-party intellectual property rights.
7. Binding Arbitration
Any dispute shall be settled by binding arbitration in Texas under the rules of the American Arbitration Association. You waive the right to participate in class actions.
8. Governing Law
This Agreement is governed by the laws of the State of Texas, without regard to conflict of law principles.
9. Modifications
We reserve the right to modify these Terms at any time. We will provide notice of material changes via email and dashboard notification at least thirty (30) days in advance. Your continued use of the Service after the effective date constitutes acceptance of the modified Terms.
10. Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
11. AI Provider Terms
Output ownership and usage rights are subject to the applicable terms of service of our third-party AI providers (Google Gemini, OpenAI, Anthropic Claude).
